1. Acceptance of Terms

By accessing or using Morphix, you agree to be bound by these Terms of Use. If you do not agree, you may not use the Service.Morphix is operated by PXV Digital Services LLC, a Delaware limited liability company ("we," "us," or "our"). These Terms apply to all users, regardless of location.

2. Description of Service

Morphix is a subscription-based platform that provides access to third-party artificial intelligence models for image and video generation. We do not develop, train, or operate the underlying AI models. All models available through the platform are built and maintained by their respective third-party providers, each with its own terms and content policies. Your use of these models through Morphix is subject to both these Terms and the applicable policies of each underlying provider.

3. Eligibility

You must be at least 18 years of age to create an account and use Morphix. By registering, you represent and warrant that you meet this requirement and that the information you provide is accurate and complete. We reserve the right to terminate accounts found to be in violation of this requirement.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at pxvbusiness@gmail.com if you suspect any unauthorized use. We are not liable for any loss or damage arising from your failure to protect your account information.

5. Permitted Uses

Morphix is designed for lawful creative and professional workflows, including content creation, visual storytelling, marketing materials, concept art, and other legitimate commercial or personal projects. You are solely responsible for ensuring that your use of the platform and any content you generate complies with all applicable laws, including copyright, privacy, and publicity rights.

6. Prohibited Content and Uses

You agree not to use Morphix to generate, distribute, or facilitate any content or activity that:

• Constitutes or depicts deepfakes, face swaps, or synthetic media designed to misrepresent a real person.
• Replicates a real person's voice or likeness without their explicit consent.
• Is sexually explicit or intimate and depicts real or realistic individuals without verifiable consent.
• Sexually exploits or depicts minors in any form, real or synthetic.
• Is intended to harass, defame, intimidate, or cause harm to any individual or group.
• Spreads deliberate misinformation or is designed to deceive the public.
• Violates any applicable local, national, or international law.
• Attempts to circumvent or disable the content safety systems of Morphix or any underlying AI provider.

Violations may result in immediate account suspension or termination without refund, and may be reported to relevant authorities where required by law.

7. Content Ownership

You retain ownership of the prompts and inputs you submit to the platform. You are solely responsible for the content you generate and for ensuring it does not infringe on the rights of third parties. Morphix does not claim ownership of your generated content but reserves the right to remove any content that violates these Terms.

8. Subscriptions and Billing

Morphix offers subscription plans billed on a recurring basis. By subscribing, you authorize us to charge your payment method at the start of each billing period. Subscriptions renew automatically unless cancelled before the renewal date. You can manage or cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you will retain access through that date.

9. Refund Policy

We offer a refund on your initial purchase if requested within seven (7) days, provided no Credits have been used. Refunds do not apply to renewal charges. Where permitted by law, a service fee of up to six percent (6%) of the original amount may be deducted. Accounts terminated due to violations of Section 6 are not eligible for refunds. 10. Third-Party AI Models

The AI models available through Morphix are developed and operated by independent third parties. We do not control the outputs of these models and do not assume responsibility for them beyond our obligations under these Terms. Each provider's terms of use and acceptable use policies apply to your use of those models through our platform.

11. Service Availability

We strive to maintain continuous availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or inconvenience caused by downtime.

12. Enforcement and Termination

We reserve the right, at our sole discretion, to suspend or terminate your access at any time for conduct that violates these Terms or is otherwise harmful to users, third parties, or the integrity of the Service. We reserve the right — but not the obligation — to monitor platform use for compliance with these Terms.

13. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will meet your requirements or be error-free.

14. Limitation of Liability

To the fullest extent permitted by law, Morphix and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of or inability to use the Service. Our total liability for any claim arising under these Terms shall not exceed the amount you paid us in the three (3) months preceding the claim.

15. Modifications to Terms

We may update these Terms at any time. Changes will be posted on this page with an updated date. For material changes, we will make reasonable efforts to notify active users. Continued use of the Service after changes constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.
